Er - yes. The decision has been made and that, by definition, sets a precedent. Of course all things are on a case by case basis, but now future cases can cite this decision as a precedent. With luck, the precedent might not endanger too many future cases, but one thing is certain, it isn't going to help (depending on your viewpoint, I suppose)
