Glad EDP were interested and the council has started to re-excavate.
My guess is your claim is against the council as the flooding of the highway is their responsibility and that's what caused the damage to your property - that the developer caused the flooding of the road is the councils problem.
I was a bit surprised when I was rear ended (whilst stationary) that the car in front claimed their damages from my insurance and my insurance then claimed it from the truck that shunted me into him, but there you go.
If your buildings or contents insurance includes legal cover I'd give them a call. Otherwise try a local solicitor with experience in suing the council. The very best of luck with it!

Surely the point is that the Council is responsible for highways and drainage - that a developer has caused them to default on their responsibilities is their problem and not Peter's.

Just sent off my claims 'dossier' to my insurers.....luckily, a combination of my previous experiences and my own anal retentiveness ensured that I have a long paper trail and piles of photos etc. Now too late to rebuild this year, so will hope to get this resolved with my insurers for a rebuild in the Spring.
