Mrs FF has much the same outlook regarding such things and, fortunately, doesn't bat an eyelid about a drum kit in the sitting room and guitar amps in the drawing room, among other 'toys'.

Just to clarify my previous comments.

If the two parties are in agreement then how you tackle it as a matter of joint decision. I still maintain that removing a tree so close to a building can potentially do as much (sometimes more) harm than leaving it. However, if you are satisfied that it can eb remvoed without adverse effect then it is for you and the neighbour to sort out.

HOWEVER, what may often start as a friendly agreement can descend into a messy legal mire if you are not careful. My previous post was simply trying to set out the situation if you and the neighbour cannot agree and you try to 'force' the issue. What I think is important to realise is that unless you can demonstrate actual damage you are unlikely to be able to force the neighbour to do anything.

My advice is therefore to keep friendly with the neighbour and do things by agreement.

I do agree with you Stephen, we want to avoid disagreement as much as possible. However,that it has caused damage to our yard is not in dispute, they agree with this, what we don't agree on is how to deal with it. Now that there is a question over the safety of the tree if the roots are cut out then it becomes a more urgent issue.......this is where I see things becoming more sticky, the more so because of the potential change of ownership, if they were staying I wouldn't worry so much. I am slow and reluctant to take things into a disagreement, and still hope to resolve this amicably!

just something else to think on, if you insist it is removed and it then does damage to their house, would you be liable?

But honestly, under the tree, and with a puppy - and him clearly not roped to the tree - how careless can you get? I know I'm prone to bouts of extreme stupidity but even I wouldn't stand underneath the running chainsaw - and to play with a puppy at the same time!!!!

It's a harsh and terribe thing to think, but I do wonder if accidents like these are Nature's way of weeding out the stupid...
