Bus Shelter in front of my Grade II Listed House

Before you fight to hard to get something done about the shelter and involve in the conservation officer - I would try and find out if they approved those windows - does not look like the sort of thing you can get away with in a listed building.

Mind you - I agree, losing the shelter and just having a sign would certainly improve the situation - and presumably save them a fortune in brown paint.

I think that comment is a little unfair.

What I think that I am actually "moaning" about is the fact that the council/bus operator are able to plonk an ugly building wherever they want, without giving consideration to the fact that all the properties in the area are listed and that this is a conservation area.

There can be no doubt that if I made an application fro p/p and listed building consent to have the a similar structure in my garen, or on the other side of my wall (as a rain shelter of course), the application would be rejected on the gounds that it was not in keeping with the property

What makes you think there is a problem with the windows - they form part of a 2003 extension, are made out of wood and are in keeping with the rest of the windows in the house

Got to say, you had my heart pounding for a second. Went to check the plans/consents etc - its all there. Mullions are constructed from local stone in keeping with the original ones at the back of the house.

Could you perhaps argue that the bus shelter is preventing access to your dry stone wall for essential maintenance? It is quite badly built and would look beautiful if redone by a really competent master craftsman dry stone waller.
Access from the garden is difficult due to the shrubs etc.

Now, that I don't know.

It looks as if it has been rebuilt recently, or increased in size. There is a darker area which is of a different style to the rest.
You could ask your CO.

You don't need LBC to carry out like-for-like repairs to a listed building.

Whilst you're about it how about losing that lamp post? And the telegraph pole? And those vents and lights on the side of the house don't look very 18th century either.
And I must agree with the previous poster that the windows in the extension do nothing for the visual amenity of the building, though that is just my personal aesthetic judgement.
One man's bus shelter is another man's eyesore. Are you pursuing an academic argument about planning law, or do you actually not like having a bus stop outside your house?

I would guess that it is that you dont like the idea of people hanging around outside your house especially kids waiting for the school bus etc, what about some nice anti vandal paint and splosh it all over the wall to stop anyone leaning on it - or even better a nice big German shepherd on a rope 2 inches shorter than the distance the kids are, that will soon stop any funny buisness.

Talking of wheelie bins, Uttlesford Council has started the biggest argument since god knows when about the introduction of them to Saffron Walden and surrounding villages, its the only story in town!!!!!! except maybe Stop Stansted Expansion

It could be that the former occupant pointed out the possibilty of removal of shelter using the listed building as a reason. The bins may belong to a neighbour.

I wonder where the bus stop/shelter is on the opposite side of the road .
and if it is the same.

I visualise the sort of place where you only get a bus stopping once in the morning and once in the evening, hardly Piccadilly circus.

The parish council probably fought tooth and nail to have a bus shelter installed in the first place so the poor sods in the village would not feel prisoners .

It may have been a straight choise between £ 1500 and a £15,000 between the existing one or one of those in Biffs pics.

It may sound cynical but " beggars can't be choosers" is a possibility here

The fact that it is in front of someone,s house that happens to be in a conveniently located street , well, someone,s house may have to suffer.

It may be lack of foresight of the 19th c. builders that your house drew the short straw, as it was built on a particularly suitable spot ideal for a future bus stop.------What else can I say-----

The chances of you getting the bus shelter removed may be as good as the drunken man not getting arrested for having a pee against the church door. When confronted by the constable all he could say in his defense was: " It is not my fault that they built the church in front of my C""K ".

jmbarker could do a lot worse than search the archive for that really interesting thread about whether you actually need lbc to build in the curtilage of a listed building, when planning permission is not required.

For some reason I can't post the url of the relevant thread but it comes up if you search on "1946" and select "garage construction...".

Even if, as we suspect, the bus shelter won't be moved, it would be interesting to see what the LA response is.

edit: jmbarker is in a conservation area, so planning permission and lbc should have been sought, I guess

I'm actually going through this mill at the moment. My house is listed grade II and my CO has advised me that, as I want to build a garage in the back garden, I need planning consent, but not listed building consent.

Thanks for the reference. The issue is whether or not LBC is required if the property is not within the curtilage.

The legislation would suggest that PP would not be required, but the councils own view (published in their own guidance) is that PP will be required, giving the central setting of the property.

As a matter of interest, there are two stops on the other side of the road - neither are in front of houses and neither have shelters.

What exactly do you want?

In your letter to the council you complained about "the rubbish left by school children" and "the single and double decker busses which park at the Bus Shelter daily."


But then, when asked where the bus-stop should be re-sited, you tell us that you'd be quite happy if they just took the shelter away and left the bus-stop where it is.

And you still haven't told us how often the buses run nor, for that matter, have you answered Andrew's question - "Are you pursuing an academic argument about planning law, or do you actually not like having a bus stop outside your house?"

I suspect that you're just amusing yourself by winding us up.

I wouldn't have bought the house if the shelter bothered me that much!

Yes, I am interested to know about the academic reasoning for its sighting and the legal basis of any removal.

There is council guidance and I want to know why it hasn't been following in relation to its original siting and the legal basis upon which it should stay.

In a perfect world it would be removed altogether. I would settle for a "bus post".

The bus(es) come about once every 15 minutes - from 6:30am through 11:00pm - I live in a villiage, but the stop serves about 6 services.

No intention to wind any body up - these postings obviously illicit comments that will be shared by the CO.

As a final aside, the Parish Council minutes from about 4 years ago, make no reference to the fact that they approved the stop. They knew nothing about it - Metro (the West Yorkshire Transport Authority) just sited it, I understand upon the guidance of the Council - probably Highways Dept, who no doubt didnt speak to the Planning Dept - which I think they should have done as....................again...........its a Conservation Area, surrounded by Listed Buildings - one of which is my house!
