Period stolen (lost?) weelie bin???

So some scumbag stole our weelie bin last week, we called the council who want 30 quid to replace it, I am not in the ''weelie bins for scumbags'' community giveaway scheme so decided to look into it further, and , apparently , wait for it , ...... the council have an agreement whereby if you supply them with a crime/event ref number they will give you a free bin.
I called the council, no such agreement exists,they said the police are giving out false information and this time round they wanted 40 quid. :shock:
I called the police who told me it does exist and they dont tend to give out false information. :shock:
They said the ref number was an ''event number'' and not a crime number as no crime had been commited , the bin was lost. :shock:
I said you cannot lose a weelie bin, they said you can. How can you lose a weelie bin? our nearest weelie bin owning neighbour is the other end of the road, the weelie bin was stolen not lost.
I called the council back who told me no such agreement exists, The police are now talking to the council about it.

Are the council taking the urine? Are the police mistaken? Is there an insurance scam going on here with the council claiming off their insurance and making us pay for a new bin?

I will be getting my soldering iron out and putting my name and address in our bins in future, also it will be in the next parish bulliten thing , somebody must have seen a scumbag weeling a bin up the road surely?

I am glad to see my two lots of council tax working for me like this, hopefully it will be 30 (or 40 when they make up their minds) quid less in the councils pension fund and a new bin for me.

Sympathies, so annoying. Have you had a walk round to see if there is one abandoned somewhere? I could imagine kids moving it as a prank and then getting bored and chucking it somewhere. A friend had a large reconstituted stone Buddha statue arrive on their doorstep, it must have been taken from someone's garden, but despite them making a police report nobody ever claimed it. After the statutory time they got a note from the constabulary that they could keep it.

If it wasn't kids then I'd imagine it was someone with a van who stopped, chucked it in the back and drove on. I can't imagine many people would want to trundle down the road with a bin - a bit obvious.

If you don't get anywhere with the police/council you may find your local paper is interested enough to send a reporter - should get you a new bin without the charge if the council are embarrassed enough.

Our local council have a team of 2 blokes with a 10 tonne truck employed full time touring the area replacing "lost" wheelie bins and recycling boxes. As far as I know, there is no charge. But where on earth do all the "lost" ones go??

Industrial units at a guess? People with 20 kids and cannot buy a bigger bin? Dog kennels?

I have now found out that the council is not going to replace it and the police were indeed giving out false information.Both the police and council have now come to this conclusion..
So , here is what I plan to do. I wont give the council 30 or 40 quid because I dont think they deserve my money, I pay two lots of council tax, one of which is for an empty house which we struggle to spend any money on to modernise so we can move into it, while the council are putting air source heat pumps and heavily insulating their houses so as to keep their tennents warm and happy not to mention plumbers with 21k bonusus and their over inflated pension schemes, blank cheques for tradesmen and personalised numberplate ''investments'' (why not invest that money in the community instead?).

Now , If I have to buy my own weelie bin (the council reckon that even though we pay for it it is still their property , yeah right and I'm Ghandi and so is my wife) I am going to buy a bright yellow one from these people instead. :lol:
How far do you reckon I will get? I bet they tell me they cannot accept that..

Tell the council you have a friend who works on the Daily Mail and you will be giving the story to her or would they simply like to replace your bin. I'm sure there must some complicated legal thing that if they say they own it then it's been stolen from them and not from you. They have an obligation to give you a bin as part of your council tax so unless they are suggesting you stole your own bin and if they are where's their evidence. You can then threaten to sue them for not providing you with a bin.
Or simply chuck your rubbish into the road and then complain to the council about the mess and health risk because they are not providing you with a bin.

We have something called a gull sack to put our rubbish bin because we can't get a wheelie bin up the lane to where the council will collect it (despite their publicity literature which says they collect your rubbish from outside your house) It's huge with a metal frame and bright green. Everyone else has a wheelie bin so the first time we put it out it was nicked - by our neighbour who said she didn't think it belonged to anyone so she took it. Some people can't help themselves.

How many bins are you allowed? We're allowed a max of 2 rubbish bins, and 3 green bins (all wheelies, and all issued foc). Check with your council, and if you're allowed more than 1, ask for your "second"!

Nope , I doubt it was him , his insurance claim tried to go 50/50 on fault but when my insurance read his insurance peoples notes to me over the phone yesterday, and I quote ''I'm Flabberghasted'' was the reply,they then recited his notes to me, you wouldnt believe the crap he is making up, and neither do they. :lol: I just seem to attract bad/looney people of late.

You may be right geeza, I will give them a call tomorrow and see what they say. I do know we are only allowed one bin and the size of this one bin is determined by the amount of people who live in the house, which is possibly why people steal bins. Before we moved we had a tiny little bin and were going to the tip every week to dispose of the rest of our rubbish as the bin lorry only comes around every fortnight.

I reckon it works like this: The Council has an obligation to offer a waste uplift service from as convenient a location as possible near your house. To facilitate this, they lend the householder a suitable bin (in most places this would be colour-coded to aid separation of waste streams). The householder has a duty of care to look after the bin which has been lent to them. Normal wear and tear is the Council's problem and they have a duty to replace the bin when it wears out or gets broken in normal use. Loss of the bin or wilful/negligent damage results in a requirement for the householder to replace the loaned bin. Outright theft (duly recorded by the Police) would, strictly speaking, be an issue for the householder's insurance (if the claim was worth it) but in practice might be seen as "just one of these things" by a pragmatic Council (but only the first time - a repeated problem might be viewed differently).

So I would go back to the Council and try to ask them reasonably to reconsider, approach a local Councillor for advice and if all else fails pay the £30.

(1) Where a waste collection authority has a duty by virtue of section 45(1)(a) above to arrange for the collection of household waste from any premises, the authority may, by notice served on him, require the occupier to place the waste for collection in receptacles of a kind and number specified.

(3) In making requirements under subsection (1) above the authority may, as respects the provision of the receptacles—
(a) determine that they be provided by the authority free of charge;
(b) propose that they be provided, if the occupier agrees, by the authority on payment by him of such a single payment or such periodical payments as he agrees with the authority;
(c) require the occupier to provide them if he does not enter into an agreement under paragraph (b) above within a specified period; or
(d) require the occupier to provide them.

Thats a bit vague Owain in that as far as I can see it says the council can either give me a bin free of charge, charge me for a bin , or charge me for letting me use their bin or I can use my own bin if it fits the bill. Am I reading this correctly?

Yes, but the problem is if they specify a receptacle which is only obtainable through the council. Eg a nonstandard size or shape of bin or a bin with a chip. It's worth reading through the rest of that Section of the Act for details of appeals etc.

We're lucky. We have two drievs and two gates. The council don't seem to realise this.... so we have been given two wheelie bins!

Mind you, since our council can't manage to send the smaller recycling lorry up a road they manage to send the huge dustcart up, we need two wheelie bins to accommodate all the stuff we throw away instead.
