Oak tree

I wonder how attached the neighbour is to that tree or whether they are using it more as an excuse to prevent your shed building? Also, do we know for certain that the neighbour planted it? We have lots of self-set trees in our ‘wilder’ areas, mostly the work of the squirrels I think.

I don’t know your plans for the rest of the land but one possibility would be to offer to plant, say, 10 new trees in more suitable areas in exchange for removing - or transplanting - that one.

Now has been passed to let the "Land Architect" have his/her says-so. Like all council planning a snail's pace is fast to them. Giving them until
the end of the week then I will appeal about their non determination within the recognised 8 week period , is now running at over 13 weeks.

Surely that 8 week period is legally binding? If they have failed to respond in 8 weeks, then you have the right to do it, don't you? That was certainly the case with a tree application I put in - the specified date passed, I legally cut down the tree the next day and the day later they sent me a letter saying I could do it!

Finally common sense has prevailed and approval give for the barn in the position I originally wanted it. Would appear the planning officer had a meeting with her boss and the decision
was made to overrule the objection from Mrs Environmentalist. They are supposed to make a decision within 8 weeks but this is now week 15 but looking positive I have got there in the end. Thanks for all

Have you given any thought to the foundation design, by the way? If you're on clay and building is to Building Regulations, you'll want to get as far away as possible. All calculations for trees are based on mature size and oak trees have a high water demand.

My arguement is why is the onus on me. It will be a 150mm concrete slab. Building regulations do not apply. As you correctly say oak trees need lots of water so let her move her tree, not me move my shed!

You said a large shed, but less that 15m^2? As you want to be close to a boundary, BR will be needed if larger than that. A 150mm slab on subbase will be susceptible to the oak tree cracking it up when it grows a bit bigger, especially in a shrinkable clay area.

The tree is there first so have to work with it I'm afraid.

Well no BR not needed and will not suffer damage because if tree causes me aggro branches and roots go west!

I love trees, but if it was my garden it was next to, it unfortunately wouldn't have survived the first storm...

The damage would be done by then, but for outbuildings it's not as important.

I had in mind a proper barn hence thinking BR required, but this sounds more like a garden shed. The lifespan of the tree is likely a lot longer!

A large shed lol. Yes the tree will probably outlive the shed by quite a margin.
