I agree with all of Flyfisher's thoughts on this, and would just add that it might be easy to misunderstand the council's word "footway". If you thought that the 12-inch strip of land adjacent to your wall was not part of the footway, then of course there would seem to be nothing to stop you digging it up.

I would, however, take the greatest care to ensure that your excavations were clearly barriered off, to stop anyone meandering into them!

The Land Registry plans don't show the porch, so not sure I want to use that as an argument...although I suspect the porch has been there longer than the LR has been in existence :lol:

Isn't there some law around nuisance and negligence. The down pipe of the upstream neighbouring property is discharging water from their roof into your property causing damage. I believe you can sue this through the small claims court but you may not want to fall out with your neighbour in such an extreme way.

On very good terms with the neighbour and we would just sort the issue between us. I have already added a 16" extension pipe so the water discharges away from the property now. No one's tripped over that, yet, and it is a very common addition to properties on this road.
