Stairs in external lightway

Hi - our house has the usual ugly and badly thought out modern steel staircase down to the basement. We'd like to replace it but as space is limited, it may be hard to do so in a way that complies with building regulations.

Has anybody had any experience of doing this? I note that part K states that the regs do not apply to stairs that are on land leading to a building but which are not part of the building. Has anybody ever used this to mean building regs dont apply?

I really don't think you'll get away with claiming that your basement is "not part of the building"!

Basement, agree, but the stairs are in the lightwell in front of the basement?
