Localism Bill overides protection for Listed Buildings etc?

Hi All

Hopefully, I have missed something or misread something.

I was browsing the recently published Localism Bill (as you do) and came across part of it that seems to suggest that the statutory protection afforded to listed buildings and Conservation Areas will not apply to Neighbourhood Development Orders.

Planning (Listed Buildings and Conservation Areas) Act 1990
22 The Planning (Listed Buildings and Conservation Areas) Act 1990 is amended as follows.

23 In section 66 (general duty as respects listed buildings in exercise of planning functions), at the end insert—

“(4) Nothing in this section applies in relation to neighbourhood development orders.”

24 In section 72 (general duty as respects conservation areas in exercise of planning functions), at the end insert

“(4) Nothing in this section applies in relation to neighbourhood development orders.”

What is a neighbourhood development thingy?

Local people can get together and apply to the local council to have their area designated as a Neighbourhood Area in which they can set various planning goals (subject to a referendum of the local people). They can then propose a Neighbourhood Development Order which grants planning permission for various things without the need to apply to the local planning authority. Seems to me a bit like permitted development on a local scale.

From the Bill itself:-

(2) A “neighbourhood development order” is an order which grants planning permission in relation to a particular neighbourhood area specified in the order—
(a) for development specified in the order, or
(b) for development of any class specified in the order.

I don't really understand the details but am a bit concerned about the apparent overriding of the current protection of Listed Buildings and Conservation Areas. Maybe I'm worrying about nothing.

Simple answer is that we aren't entirely sure ourselves (except that Neighbourhood Development Orders will stil have to comply with existing national and local planning policy - the question is what that policy will be. At present irt appears that the Gnomes of Whitehall are drafting new guidance to replace all the planning policy, even the brand new PPS5, with a Janet and John document to suit Mr Pickles the Hard of Understanding)

I can proudly tell you that I am an expert on the green ( even remember the colour!!) of those janet and John books. When I came to England (at the age of 15) I was humiliated by my school chums when the year ( 15 !!) teacher tried to improve my pigeon English by making me read THOSE books. And learn I did !! :wink: . ( never managed to get rid of the pigeon though)
Now, as to Eric Pickles.........( I am sure he was sitting on the desk in front at King harold school in Waltham Abbey :wink: ).

In which case, Middi, may I commend to you some of the CDs that have been produced of Terry Wogan's "Janet and John" tales. They were a regular feature of his morning programme on Radio 2, and raised the art of double entendre to a new level.

They had some of the original drawings from the Janet & John books on the Antiques Roadshow recently. Owned by a neighbour who was accompanied by her son, the original John model. It seems the bloke would turn up at tea-time or bath time and draw the neighbour's kids... would never be allowed these days :roll:
