Listed buildings judgment

A long shot - I'm in urgent need of the details of a legal judgment I THINK 2004 or 5 - poss Judicial Review - where it was held that the Sec of State was correct in not listing a building because it had 'design flaws' when new.

I think a school, I think London, I have it all somewhere but I have stuff to write urgently referring to it and amongst the tottering piles of paperwork I have (it's partof a case involving a listed building) I can't find it.

If anyone has better luck googling than I have please let me know!

Thanks hugely - it may be that, in fact I think it is, I know of the case through other ways, very sad one actually. Pimlico very interesting school building. Lot of controversy.

Hadn't put two and two together as it was just X versus the Sec of State. I knew the outline.

Ho hum. The garden look so much more inviting that doing all this!

No the garden doesn't, it's very cold out there and snow is threatening. The winter digging should have done ages ago and it's better to keep off the soli at the moment.

Oh, OK. I blame you for starting all this anyhow! ;-))

But yes - it's Pimlico School I was after, wher the design was deemed flawed as it got too hot (as indeedd did my school) and louvres had to be added later. Brilliant.

However - in the case I'm arguing, the supposed 'expert' researcher got it very wrong.

It's not much use saying something happened at a certain date then putting in drawings showing it was ten years earlier...

In my usual anorak manner I have quoted chapter and verse.
