Hi again

well now, do we need to ask anyone for any sort of permission if we want to fell a 40 foot (ish) high Leylandiiiiii tree - it's got far too big and is planted completely in the wrong place right up against the inside of our perimeter wall near our gate

I have heard that for certain trees you need permission but wasn't sure if this related to size of tree or type of tree

NB love trees - wood never fell a tree (groan!) unless was absolutely necessary - but this enormous thing is monstrous carbuncle with attitude.

I have a feeling you can chop it down but don't know for sure. I find gardenlaw.com is marvellous for all garden-related queries. Don't read too much of it though as it's a bit depressing (all the neighbours from hell stories).

Your local authority should have someone with duties of Tree Protection Officer, who should be able to advise if there is a tree protection order in force. It's unlikely.

Remember that the timber will be very useful, a durable wood good for building rose pergolas and such like outdoor structures. It will take a very long time to rot.

If it has a TPO on it then you need permission but I would have thought that this would have been very very unlikely for a Leylandii. If it is within a conservation area than I believe you need permission also (not that that stopped our neighbours).

I'm shortly going to remove a large cherry from the garden as its taken over and we have a lot of nicer trees. Might think about using some of that wood in the kitchen.

thanks guys - No TPO on it - have polled neighbours - they hate it too - it was 4 feet high when planted in (neighbour thinks ) 1992 ish

They really do grow fast - might start Xmas tree plantation - probably would need bigger garden though !!!

We are in a tree conservation area and you are required to get permission for any trimming/felling. That said they are very understanding here (Scotland) and we have had no problem getting rid of certain (a large rotten cherry, dead elms and a 60ft poplar 3 feet from the house!). I would say your leylandi should qualify Ok but best to ask if you are in a conservation area.

When hiring a tree person best to find someone strongly recommended, as if a cowboy gets it wrong it could be unfortunate!

On the other hand, if you do have a tree nearby that you love and don't want to disappear then it might be worth trying to get a TPO put onto it. My parents came back from a funeral to find that the large tree at the bottom of their garden had disappeared whilst they where away. It was just over the fence so the land didn't belong to them and there was no TPO so there was nothing they could do. The tree was in the centre of town with few others of a similar size nearby so I would have thought a TPO would have been appropriate but you can't apply for one once it has been cut down....

Tree Preservation order - how would I preserve it? - would need a lot of pectin!!

I emailed pectin makers to see if they did bigger sizes and haven't had a reply yet from last year, maybe I ought to try again as will be buying it shortly

If you are in a Conservation Area all trees are covered and require consent from the local Tree Officer to prune, reshape or fell. However most tree officers are very sympathetic to the plight of leylandii owners and neighbours and allow removal. Our local man even offers a 'what to replant' service.

I've never had to resort to pectin... for jam or trees.

If in doubt, preserving sugar adds a little more. But I like soft set.

Just chop it down ( a lovely young tree in the incorrect surroundings usually grows into a sprawling monster).

If you get sued by anybody quickly plant another one, whilst the legal process takes it's course the planted one will be as big as the chopped one.

thanks for all replies

checked with local authority website and we're not in a conservation area - SLDC only list towns and certain villages as conservation areas and we're outside the scope of the scary Lake District NPA, also checked Lancaster City Council just in our local area falls under their conservation policy - being in border country we are in Lancashire but within SouthLakeland District council jurisdiction, so thought I'd better check.

Anyway -we're not, nobody cares, none of neighbours mind, birds don't go near it so the hideous light sucking, overhead cable snagging, soil acidifying, foundation wobbling monster is going - HA HA Ha HAAAAAAA!!! (Veerrrooomm!! - that is chainsaw noise!)

How strange. The Leylandii nearest to our bedroom window is a tawny owl roost. The next tree has a collared dove nest and the rest of the hedge regularly sleeps 300 starlings. Small brown jobs abound in the lower thicket.

Tis wondrous strange indeed - They nest and roost aplenty in the other trees - I would have thought that they'd love it as it's dense and dark - our local tree hippie (arboriculturist) has been up to inspect it for surgery purposes and noted that there is no evidence of any old nests anywhere. Perhaps bird population know that it is part of pathfinder programme and loal government will be demolishing to make way for redevelopment !

Hey Shelli, Make a young (ahem!!) woman happy and post a pic of the tree surgeon in action!!!! Certainly made ME feel better about felling a beautiful walnut tree last year! (It was covering the WHOLE, yes the WHOLE of our garden!!)
