Access query

Hi,I wonder if any one out there can answer this query....
Our house has a large garden to the front.We cannot take down the garden wall at the front to get access for parking because the highways say there is insufficient visibility down the road (to the right) as we are on a sharp bend.
Our neighbour who also has a large garden has got access for parking. He is agreeable that we get an easement across his property to reach our garden for parking the cars.Obviously we will have to knock down some of the wall between the two properties to facilitate this.Again our neighbour is in agreement.

If we went ahead with this idea would we have to seek permission from the council or inform them or any other body?

I'd employ a solictior to do it, he'll know who/what should be asked.
I certainly wouldn't do it without one as when your neighbour moves or you do all sorts of problems will begin, not to say what would happen if you have a falling out with your neighbour.

We relaid our drive and had planning come to visit as someone had complained we were laying a new driveway, which would have needed planning permission, so I guess if you make a new driveway you will most likely need pp.

Are you in a conservation area?

(You might also have complaints from various bodies - using gardens for parking is something the CPRE is grumbling about...)

If you had been ina conservation area you would in all probability have had to apply for consent to demolish the wall etc.

I would still contact the local authority for advice before going ahead. It may be considered that more traffic from the existing access will be a problem, you may find that buildings regs approval will be required...

Certainly if all is OK you will need a legal easement over the neighbouring land, with such details as maintenance sorted out also.
